Stewart Pools agrees to provide Executive, Economy, Chemical, or Add-on Option packages in accordance with the terms set forth below. The initial term of this agreement is on a month-to-month basis, and can be cancelled by the Customer with a written notice effective thirty (30) days after the written notice date. Stewart Pools reserves the right to cancel or refuse service at any time. All service rates are based on the pool and associated equipment being in normal operating condition (as per the Equipment Manufacturer’s specifications).

Service Options:

EXECUTIVE $190 *Weekly Full Service Maintenance* Stewart Pools will provide all chemicals, test chemicals in water, backwash applicable filters, clean all baskets and debris traps, leave notification of service, notify Customer of any pool/equipment issues, brush, net, and vacuum pool when necessary. Customer is responsible for maintaining appropriate water level in pool.ECONOMY $149 *Weekly Chemical/1 Clean per Month Maintenance* Stewart Pools will provide all chemicals, test chemicals in water, backwash applicable filters, clean all baskets and debris traps, leave notification of service, notify Customer of any pool/equipment issues, and provide services listed under Weekly Full Service Maintenance one (1) week out of the month, provided pool is not excessively dirty, (to be determined by Stewart Pools). Customer is responsible for maintaining appropriate water level in pool.CHEMICAL $99 *Weekly Chemical Only Maintenance* Stewart Pools will provide all chemicals, test chemicals in water, backwash applicable filters, clean all baskets and debris traps, leave notification of service, and notify Customer of any pool/equipment issues. Customer is responsible for maintaining appropriate water level in pool.

Add-On Options

Filter Cleaning Option

Add semiannual D.E. Filter Cleans to any Service Plan for $20.00 per month.Add quarterly Cartridge Filter Cleaning to any Service Plan for $40.00 per month.

Stewart Pools will perform two D.E. filter cleans per year (April & October) *OR* 4 Cartridge filter cleans per year (January, April, July & October). Customer understands that by refusing the Filter Clean option they are running the risk of damaging their pool filter. All major filter Manufacturers recommend the D.E. filter be serviced at least twice per year, and Cartridge filters at least 4 times per year. Stewart Pools will not be responsible for filters that are damaged from lack of Manufacturer's recommended maintenance.

Quarterly Salt Cell Inspections :

Add quarterly Salt Cell Inspections to any Service Plan for $20.00 per month. Stewart Pools will perform 4 salt cell inspection/cleans per year (January, April, July & October). *Customer understands that by refusing the Salt Cell Inspection option they are running the risk of damaging their salt system. All major salt system Manufacturers recommend the system be serviced at least 4 times per year. Stewart Pools will not be responsible for salt systems that are damaged from lack of Manufacturer's recommended maintenance.

Annual Automatic Pool Cleaner Inspection:

Add an annual Automatic Pool Cleaner Inspection to any Service Plan for $10.00 per month. Stewart Pools will perform one Automatic Pool Cleaner Inspection per year (April). *All major Automatic Pool Cleaner Manufacturers recommend the cleaner be serviced at least once per year. Stewart Pools will not be responsible for cleaners that are damaged from lack of Manufacturer's recommended maintenance.

Terms of Service

I AGREE WITH TERMS OF SERVICE: Customer will be billed monthly for selected services, plus any applicable sales taxes and fuel surcharge fees for selected services. All services are prepaid. The Customer will be billed on the 20th of each month. All payments are due by the 1st of the following month. If the account balance is not paid in full by the 5th of each month, the service will be suspended. The Customer will not receive credit for any missed service calls that are caused by suspension. The Customer will be held responsible for any additional issues or charges that may arise due to the absence of service caused by suspension. After 30 days of delinquency, the account will be closed and legal action will be taken to collect any unpaid balances. If Stewart Pools is unable to collect monies for services rendered, the company will take legal action and file a claim against the Customer, and that Customer will be responsible for any unpaid balances, fees, court costs, and liens. Credits for a partial service call, or absence of a service call that is directly caused by customer equipment failure will not be issued. Equipment failures will be determined by Stewart Pools, in accordance with equipment Manufacturer's specifications. Make up service for a partial service call, or absence of a service call that is directly caused by inclement weather will be issued only upon verbal or email request from the Customer. Inclement weather is defined as temperatures below 35 degrees Fahrenheit, any form of precipitation, lightening, and winds exceeding 25 miles per hour. Any separate services performed by Stewart Pools (parts, repairs, equipment) will be invoiced separately and payable immediately upon completion or delivery. The Customer agrees that necessary replacement of small part items such as cleaner parts, baskets, etc. up to $60.00 are pre-approved by this Service Agreement and charges will be automatically applied to the credit card on file. There is a $30.00 processing fee for all returned checks. Stewart Pools reserves the right to change the day of weekly service, service rate, and any other terms of this agreement without notification to the Customer.
